Age Discrimination in Employment

I. Introduction

As I think about a career change at age forty-four, I face the prospect of re-entering the work force as a new graduate who will be close to fifty. Age discrimination in the area of employment is a topic of interest to me. Life expectancy has increased throughout this century. People born in 1900 could expect to live to age forty-seven. By 1978 life expectancy had risen to seventy-three years (O'Meara, p. 20). According to the Census Bureau by the year 2050, 21.8 percent of the population will be sixty-five or older (O'Meara, p. 20). This "graying of America" is also occurring in the American work force (O'Meara, p20).

Blacks Law Dictionary 6th Edition, defines discrimination as "the unfair treatment or denial of normal privileges to persons because of their race, age, sex, nationality, or religion. A failure to treat all persons equally where no reasonable distinction can be found between those favored and those not favored." The Wagner Act of 1935 was the first statute that attempted to protect workers in the work place from unfair employment practices. Neither statutory or common law protected older workers. The Equal Employment Opportunity Act of 1962 was the first attempt to specifically prohibit age discrimination in employment. This bill would have prohibited employment discrimination because of age, race, religion, color, national origin or ancestry, however it was blocked in the House Rules Committee. There was another attempt to attach age discrimination to the Civil Rights Act of 1964 but the proposed amendment was voted down. One of the reasons given for the vote was that Congress did not have enough information to legislate age discrimination protection. Congress then directed the Secretary of Labor to study age discrimination in the area of employment. In his report, The Older American Worker: Age Discrimination in Employment, Secretary of Labor Wirtz distinguished between race discrimination and age discrimination. Unlike race discrimination, age discrimination was not based on dislike but rather on "incorrect stereotypes" (O'Meara, p12). Age discrimination was added to the Fair Labor Standards Act, but this was also rejected by the Senate Committee. In 1967 President Johnson proposed that Congress enact a law prohibiting "arbitrary and unjust discrimination in employment because of age" (O'Meara, p14). The Age Discrimination in Employment Act was signed into law by President Johnson on December 15, 1967.

29 U.S.C.S. s 621 Congressional Statement of Findings and Purpose

(a) The Congress hereby finds and declares that -

1. in the face of rising productivity and affluence, older workers find themselves disadvantaged in their efforts to retain employment, and especially to regain employment when displaced from jobs. 2. the setting of arbitrary age limits regardless of potential for job performance has become a common practice, and certain otherwise desirable practices may work to the disadvantage of older persons; 3. the incidence of unemployment especially long-term unemployment with resultant deterioration of skill, morale, and employer acceptability is, relative to the younger ages, high among older workers; their numbers are great and growing; and their employment problems grave; 4. the existence in industries affecting commerce, of arbitrary discrimination in employment because of age, burdens commerce and the free flow of goods in commerce.

(b) It is therefore the purpose of this Act (29 USCS ss 621 et seq.;) to promote employment of older persons based on their ability rather than age; to prohibit arbitrary age discrimination in employment; to help employers and workers fin ways of meeting problems arising from the impact of age on employment. (Dec. 15, 1967, P.L. 90-202, s2, 81 Stat. 602)

b. Westlaw. The topic of Age Discrimination can be searched using the above key numbers.

c. Lexis. The topic of Age Discrimination can be searched using Age Discrimination in Employment Act as a search term. A search of GenFed using this term brought up over 1000 cases. A search of Supreme Court cases using this term brought up 46 cases. The first case was O'Gilvie et al V United States, 1996.

In the section of entries titles "Employment" is the entry for 58 ALR Fed 94, "evidence that discharge was because of age, for purposes of Age Discrimination In Employment Act. b. Sources of Compiled Legislative Histories. Johnson, Nancy P. American Association of Law Libraries. Littleton, CO. 1979. This book is a bibliography of government documents, periodicals, articles and books. The legislative histories span the 1st Congress to the 94th Congress. I did not find this to be a very useful or timely book. There were only four entries under P.L. 90-202, The Age Discrimination in Employment Act.

There is a cumulative index in the back of each volume. Age discrimination is in Volume 56. There is a table of cases in the front of each volume.

b. Fair Employment Practice Cases. BNA. Washington, DC. 1994. Full text of actual cases. There is a cumulative digest, index and table of cases. There are classification numbers that refer to points of law. The classification numbers are found through the topic finders. The classification number for Age Discrimination is 106.13.

c. Federal Age Discrimination in Employment Act: Slowing down the Gold Watch. Edelman, Charles. Michie Co. Charlottesville, NC. 1978. Review of the history of the statute and attempts to challenge it. This book attempts to provide practicing attorneys with a complete statement of the law as it has developed since 1967.

d. Age Discrimination in Employment Law. Kalet, Joseph E. BNA. Washington, DC, 1986. Information on available case law and regulations through 1985. Includes a legislative history section, coverage by the ADEA, remedies and enforcement procedures.

e. Age Discrimination in Employment. Kendig, William. AMACOM (Div. of the American Management Association). New York, NY. 1978. This small book has a business thrust. It is like a handout designed to alert managers and employers to the presence of ADEA. Includes a brief overview of the problem, the legislation and the major court actions.

f. Federal Law of Employment Discrimination in a Nutshell. West Publishing Co. St. Paul, MN. 1992. Chapter 16 covers Age Discrimination and the Age Discrimination in Employment Act.

g. Protecting the Growing Number of Older Workers: The Age Discrimination in Employment Act. O'Meara, Daniel. The Wharton School, University of Pennsylvania. Philadelphia, PA. 1989. This is an excellent overview of the ADEA and how it came to be.
